This course studies the principles of obligations in the positive civil law. It deals with the effects of obligations, namely, execution: voluntary (e.g., payment, and execution with the equivalent of payment) and obligatory (specific performance and compensation), and the lawful means for protecting execution (e.g., indirect law suit, simulated contract case, case for the ineffectiveness of the debtor’s dispositions, interdiction of the bankrupt debtor, and the right of withholding). It studies the characteristics of obligation (e.g., the condition “Proviso” and the maturity period, plurality of the subject-matter, and plurality of parties and their joint liability), and conveying the obligation transferring rights and debts and finally termination of obligation (e.g., the discharge, the impossibility of performance, and limitation of court actions).
