This study analyzed the provisions of the Palestinian Insurance Law and the Palestinian Traffic Law to determine what a road accident is, considering that the applicability of the description of a road accident in accordance with the insurance law is what makes an accident subject to the law and covered by insurance companies’ compensation. In light of the lack of legal jurisprudence writing on this topic despite its importance, this study sought to clarify the elements of a road accident in terms of its definition, the definition of the vehicle, the road, and the road accident conditions, by clarifying concepts that are still controversial, such as the terms "vehicle use" and "while traveling", in light of some deficiencies in the texts, which may deprive the injured of the benefit from insurance. Judicial jurisprudence had an important role in controlling the road accident elements, thus removing ambiguity surrounding the legislator phrases.
